Terms and Conditions for use of the Nasomatto webstore

These terms regulates all users of nasomatto.com. They will be valid for all your future transactions with Nasomatto and visits to nasomatto.com. These conditions regulates sales of perfumes or other products by nasomatto.com to private individuals. This website is destined exclusively to private individuals. The conditions of sales mentioned herafter concern only nasomatto.com and are not related to any other conditions as for as those which are applied in stores. Nasomatto reserves the right to revise these terms and conditions. The date of the latest update is found at the end of the Terms and Conditions. Users are responsible for keeping themselves updated with such changes.

Disclaimer

We do not guarantee that all the items available at the nasomatto.com online shop are in stock at the time of your order. In the case of incorrect stock balance affecting your order we will contact you by e-mail. Nasomatto cannot warrant that the content of nasomatto.com is at all time free of inaccuracies or typographical errors. Neither can we guarantee that all information is up-to-date. Nasomatto may at any time change the content of the site and the items available in the product range. Though we strive to always display the correct texts, images and pricing in the site and web shop, errors may occur. If you have been charged the wrong amount when shopping from the web shop, we will give you the option of placing a new order with the correct price or canceling your order. If we are unable to get in touch with you, your order will be automatically cancelled. Part of the services mediated through nasomatto.com are performed and concerned for by outside organizations. In situations where Nasomatto act as agent for such services, we cannot be held responsible for any errors resulting from their activities. Nasomatto cannot be held responsible for any damage caused from using the site or not being able to use the site. Nasomatto cannot guarantee a problem-free, uninterrupted and secure access to the web site.

Trade Marks

Our trade marks include (amongst others) the Nasomatto name and logo. These trade marks may be used or registered in more than one country and your use of this web site does not grant you any rights to use our trade marks.

Privacy Policy

All personal information saved at www.nasomatto.com will be handled with most care. The information that we store will not be sold or used for any purposes other than making sure you get the best service possible. It will solely be used for informing you about special offers and other marketing activities related to Nasomatto. Your personal data may be disclosed to third parties only when it is necessary to fulfill the purposes described above. When registering to our web shop, you can choose not to receive information from Nasomatto. If you wish to end your subscription to information from us, send an email to webstore@nasomatto.com stating your email address and a short description of the matter. You have the right to at any time know what information is kept about you in our systems. This information can be requested by sending an email to webstore@nasomatto.com. If the information is incomplete or incorrect, you have the right to have the information corrected or deleted. All customers paying by card are subject to validation checks by Moneybookers.com. Nasomatto makes the reservation to delay any order if we suspect a further security control is needed.

Security

The Nasomatto webstore uses Secure Socket Layers (SSL), the industry standard in transferring information to process your orders. You can recognise the part of the site that make use of SSL by checking your browser adress bar, where the nasomatto.com adress starts with https:// instead of http://. This SSL encryption to process data from and to the site in a secure way is only used on parts of the store where this is rendered neccesary, where information about your account is being transfered.

Cookies

Nasomatto.com uses cookies in order to improve your experience of the site. The cookie identifies your computer and allows the site to remember your personal settings. Cookies are also used for statistical purposes. You can set your browser to notify you when a cookie is to be activated. This enables you to reject usage of this cookie or to tell your browser to erase the cookie at the end of your visit. The web shop cannot be used if you disallow cookies.

Payment and Prices

We accept payments by Paypal. The full amount will be charged on the date of the order. Prices include Dutch VAT at 21 % when shipped in within Europe, and products are tax exempt when shippid outside EU. Shipping costs will be added to your order. Please view Shipping in the section FAQ for shipping charges. Orders to countries outside the European Union (EU) or to the United States may be subject to VAT, import duties and/or taxes, which are levied once your package reaches your country. On orders to countries outside of the EU, we cannot predict what your particular charges may be. These additional charges must be rendered by you in order for your package to clear customs. Please contact your local customs office for more information.

Exchanges and Returns

During 14 days following the delivery of your order, you may request the exchange or refund of items, which you must return to us in unused condition accompanied by the original invoice. Returns will only be accepted if labels and original packaging are fully intact. The Nasomatto webstore cannot accept returns where labels have been removed. You are responsible for the shipping of returned items back to Nasomatto. Items lost in transportation will not be compensated for. Shipping charges on returned merchandise are at the customer's expense. Refunds for returned merchandise will be made within two weeks of the return of the product, to the original purchaser’s credit card. Note that additional duties and/or taxes will not be refunded. Neither will shipping costs. VAT will be included in the refund. All exchanges are subject to availability. Faulty items will be exchanged to the same type of product, subject to availability. Refunds for faulty items can be made within the 14-day period following delivery. Exchanges and returns can only be made as described in Nasomatto webstore's instructions, which will be e-mailed to you in such case. Items cannot be exchanged or refunded at other stores than the webstore.

Customs

Nasomatto perfumes may contain ingredients that cannot be imported into some countries. Please check with your local customs. Nasomatto will NEVER be held responsible for import-issues that arise from placing an order in our webstore.

Violation of rules

Nasomatto reserves the right to seek all remedies available at law and in equity for violations of these Terms and Conditions, including the right to block access to the site. Individuals violating the restriction of password protected areas of the site may be subject to prosecution.

Force Majeure

In case of Force Majeure, Nasomatto's obligations are procrastinated. The contract between you and Nasomatto can in such cases be partially or fully terminated by yourself or by Nasomatto. A Force Majeure is at the event of war, civil war, revolution, riot, governmental measures, strike, lockout, blockage, failure of electricity, telephone or internet service, natural disasters or similar events. Nasomatto will under such circumstances do all we can to solve the matter for our customers as soon and entirely as possible.

Governing Law

These terms and conditions are construed in accordance with Dutch law and you agree that the Dutch courts will have exclusive jurisdiction for any dispute under this agreement. The laws of you country may be different from the laws in The Netherlands and there may be additional legal requirements for you to use this website. You must comply with all applicable local and international laws and regulations regarding your use of our website and the ordering of products on it.
